EXECUTION SCHEDULED TONIGHT

DEATH-ROW INMATE HUBERT MICHAEL IS SCHEDULED TO RECEIVE A LETHAL INJECTION TONIGHT AT THE ROCKVIEW STATE PRISON IN CENTRE COUNTY. THE STATE PARDONS BOARD WEDNESDAY UNANIMOUSLY VOTED NOT TO GRANT CLEMENCY TO THE 56-YEAR-OLD MICHAEL, WHO PLEADED GUILTY TO THE 1993 MURDER OF A TEENAGE GIRL IN YORK COUNTY. MICHAEL'S LAWYERS CLAIM HE SUFFERS FROM MENTAL PROBLEMS THAT CLOUD HIS JUDGMENT. MICHAEL WOULD BE THE FIRST PENNSYLVANIA INMATE PUT TO DEATH IN 13 YEARS. A VIGIL IS PLANNED FOR 5PM OUTSIDE THE PRISON TO PROTEST THE EXECUTION.

CONVICTED OF MURDER

A CENTRE COUNTY JURY YESTERDAY CONVICTED 21 YEAR OLD TYLER MARLATT OF STATE COLLEGE OF 2ND AND 3RD DEGREE MURDER IN THE JANUARY STABBING DEATH OF 20 YEAR OLD TYLER STRUBLE. POLICE SAY STRUBLE STOLE 20-DOLLARS FROM MARLATT’S GIRLFRIEND FOLLOWING A BOTCHED MARIJUANA DEAL, THEN MARLATT WENT TO THE LEMONT HOUSE WHERE STRUBLE WAS STAYING. MARLATT RECEIVED A LIFE SENTENCE.

BEATING VICTIM DIES

A CAMBRIA COUNTY MAN DIED WEDNESDAY AFTER BEING BEATEN WITH AN ALUMINUM BASEBALL BAT 2 DAYS EARLIER. SUMMERHILL TOWNSHIP POLICE SAY 50 YEAR OLD GREGORY CONZO WENT TO THE WILMORE HEIGHTS HOME OF MICHAEL PCOLA AND GOT INTO AN ARGUMENT WITH PCOLA’S SISTER, THE MOTHER OF HIS CHILD…HITTING HER IN THE LEFT ARM WITH THE BAT.
BEFORE HE FLED, HE STRUCK THE 50 YEAR OLD PCOLA IN THE HEAD. HE DIED LATER AT JOHNSTOWN’S MEMORIAL MEDICAL CENTER. CONZO IS IN THE COUNTY JAIL AND THE INVESTIGATION CONTINUES.

ORDERED TO TRIAL IN FRIEND’S DEATH

IN BEDFORD COUNTY COURT YESTERDAY, 51 YEAR OLD RANDY FOOR OF BEDFORD WAIVED HIS PRELIMINARY HEARING ON CHARGES OF INVOLUNTARY MANSLAUGHTER AND AGGRAVATED ASSAULT. POLICE SAY HE AND HIS FRIEND, 49 YEAR OLD DENNIS SPRIGG OF MANNS CHOICE, HAD BEEN DRINKING AT A PARTY ON AUGUST 11TH WHEN AN ARGUMENT BEGAN. IT TURNED PHYSICAL, AND FOOR PUSHED SPRIGG WHO FELL AND HIT HIS HEAD ON THE BLACKTOP. HE DIED MORE THAN A MONTH LATER. FOOR REMAINS IN THE COUNTY JAIL.

DAY CAR PROVIDER ORDERED TO TRIAL

38 YEAR OLD JALENE MCCLURE OF STATE COLLEGE WAS ORDERED TO STAND TRIAL YESTERDAY FOR ALLEGEDLY SHAKING A 5 MONTH OLD BABY SO HARD SHE CAUSED A SKULL FRACTURE. IT HAPPENED IN AUGUST OF 2010 WHEN MCCLURE OPERATED A HOME-BASED DAY CARE CENTER IN SPRING TOWNSHIP. MCCLURE TOLD POLICE SHE TRIPPED AND FELL WHILE HOLDING THE BABY.

SANDUSKY SCANDAL

FORMER PENN STATE PRESIDENT GRAHAM SPANIER IS FREE ON 125-THOUSAND DOLLARS UN-SECURED BAIL AFTER BEING ARRAIGNED IN HARRISBURG YESTERDAY ON CHARGES THAT HE LIED ABOUT THE JERRY SANDUSKY SCANDAL AND HELPED TO COVER IT UP. THE CHARGES AGAINST SPANIER INCLUDE PERJURY, OBSTRUCTION, ENDANGERING THE WELFARE OF CHILDREN, FAILURE TO REPORT SUSPECTED ABUSE AND CONSPIRACY. SPANIER HAD TO SURRENDER HIS PASSPORT AND HE’S NOT ALLOWED TO TRAVEL OUTSIDE OF PENNSYLVANIA. A PRELIMINARY HEARING IS SET FOR NEXT FRIDAY, BUT IS EXPECTED TO BE POSTPONED. HIS ATTORNEY SAYS “WE LOOK FORWARD TO THE CHANCE TO PRESENT HIS SIDE OF THE STORY IN THE FUTURE.”

FORMER PENN STATE ADMINISTRATORS TIM CURLEY AND GARY SCHULTZ ARE SCHEDULED TO STAND TRIAL IN JANUARY, BUT PROSECUTORS ARE NOT OBJECTING TO THE OTHER SIDE’S MOTION FOR A DELAY. THE DEFENSE CLAIMS THEY NEED MORE TIME TO GO THROUGH A LARGE AMOUNT OF MATERIALS TURNED OVER TO THEM BY THE PROSECUTION IN THE PRE-TRIAL DISCOVERY PROCESS. IN NEW COURT PAPERS, PROSECUTOR BRUCE BEEMER WROTE THAT STATE OFFICIALS WANT ONE TRIAL FOR SCHULTZ, CURLEY, AND FORMER PENN STATE PRESIDENT GRAHAM SPANIER WHO WAS INDICTED LAST WEEK. HE PLANS TO FILE A MOTION TO THAT EFFECT SOON.

A JUDGE HAS SET FRIDAY NOVEMBER 16TH AS THE NEW DATE FOR THE COURT HEARING AS PENN STATE HOPES FOR A STAY IN THE MIKE MCQUEARY LAWSUIT. MCQUEARY'S WHISTLEBLOWER SUIT SEEKS 4-MILLION DOLLARS IN DAMAGES. THE HEARING WAS ORIGINALLY SCHEDULED LAST WEEK, BUT WAS POSTPONED DUE TO SUPERSTORM SANDY. ACCORDING TO THE CENTRE DAILY TIMES, PENN STATE’S BOARD OF TRUSTEES IS ALSO SET TO MEET THAT SAME DAY.

FIRE NEAR STATE COLLEGE

A FIRE EARLY WEDNESDAY AFTERNOON CAUSED HEAVY DAMAGE TO A FERNWOOD COURT HOME IN THE HERITAGE VILLAGE APARTMENT COMPLEX OUTSIDE OF STATE COLLEGE. FIREFIGHTERS SAY 2 PEOPLE WERE INSIDE, BUT WERE ABLE TO ESCAPE SAFELY. THE CAUSE OF THE BLAZE REMAINS UNDER INVESTIGATION.

DIAMOND RINGS STOLEN FROM JEWELER

CAMBRIA TOWNSHIP POLICE SAY 2 MEN STOLE OVER 11-THOUSAND DOLLARS WORTH OF DIAMOND RINGS FROM DECKER DIAMOND JEWELERS OFF ROUTE 22 TUESDAY AFTERNOON. THE SUSPECTS WALKED INTO THE STORE…LOOKED AT THE RINGS…THEN GRABBED THEM AND TOOK OFF.THE STORE OWNERS ARE OFFERING A 1-THOUSAND DOLLAR CASH REWARD TO ANYONE WITH INFORMATION LEADING TO AN ARREST AND CONVICTION.
