DOUBLE MURDER TRIAL CONTINUES

8 MORE WITNESSES TOOK THE STAND DURING DAY 2 OF THE DOUBLE MURDER TRIAL OF NICOLAS HORNER OF ALTOONA, INCLUDING THE SUBWAY EMPLOYEE WHO WAS SHOT IN THE HIP BACK ON APRIL 6TH, 2009…THE SAME DAY HORNER KILLED SCOTT GARLICK AT THE RESTAURANT AND RAYMOND WILLIAMS NEARBY. MICHELLE PETTY TOLD THE JURY HORNER ALSO PUT A GUN TO HER HEAD AND SAID “DON’T MOVE, OR ELSE”…THEN SHE HEARD HIM DEMAND MONEY FROM THE FRONT OF THE RESTAURANT. THE DEFENSE SAYS THE IRAQ WAR VETERAN SUFFERED FROM POST TRAUMATIC STRESS AND DOESN’T DESERVE THE DEATH PENALTY. WILLIAMS’ WIDOW ALSO TESTIFIED ALONG WITH 3 ALTOONA POLICE OFFICERS. ONE OFFICER SAID HORNER CLAIMED A FRIEND WAS RESPONSIBLE FOR THE MURDERS AND THAT THE INSIDE OF THE RESTAURANT WHERE IT HAPPENED SEEMED LIKE THE VIDEO GAME HE HAD BEEN PLAYING. ANOTHER POLICE OFFICER READ THE STATEMENT HORNER MADE AFTER HIS ARREST. HE SAID HE WAS KIDNAPPED BY A MAN AT GUNPOINT…GOT FREE…AND WAS FORCED TO TAKE CASH FROM SANDWICH SHOP. AT SOME POINT, HE LOST HIS GUN.

MURDER RE-TRIAL SCHEDULED

THE CENTRE DAILY TIMES REPORTS THAT THE RE-TRIAL FOR FORMER PENN STATE STUDENT ANDREW ROGERS HAS BEEN SET TO BEGIN MAY 7TH. JURY SELECTION WILL START APRIL 2ND. ROGERS WAS CONVICTED OF 3RD DEGREE MURDER IN THE 2006 BEATING DEATH OF YOUNG-CHEOL PARK IN STATE COLLEGE. THE CONVICTION WAS OVERTURNED BECAUSE PROSECUTORS WITHHELD INFORMATION THAT COULD HAVE BOLSTERED HIS DEFENSE. ROGERS’ LAWYER HAD ARGUED THAT A RE-TRIAL WOULD AMOUNT TO DOUBLE JEOPARDY.

SANDUSKY WILL GET MORE INFORMATION

THE JUDGE HANDLING THE JERRY SANDUSKY CASE YESTERDAY ORDERED PROSECUTORS TO TURN OVER TO THE DEFENSE THE PHONE NUMBERS AND ADDRESSES OF THOSE WHO HAVE ACCUSED THE FORMER COACH OF MOLESTING THEM. DEFENSE ATTORNEY JOE AMENDOLA MAY ALSO GET PSYCHOLOGICAL EVALUATIONS, BUT HE STILL PLANS TO FILE A MOTION TO DISMISS CHARGES LATER THIS WEEK. JUDGE JOHN CLELAND ALSO SAYS THE STATE MUST DISCLOSE ANY JUVENILE ARREST RECORDS THAT MIGHT HELP AMENDOLA ATTACK THE ACCUSER’S CREDIBILITY. THIS DOES NOT APPLY TO DRUG OR ALCOHOL VIOLATIONS.

PENN STATE INSURANCE WILL PAY

PENN STATE OFFICIALS NOW SAY THE UNIVERSITY’S INSURANCE WILL PAY THE LEGAL FEES OF EMPLOYEES WHO WERE RECENTLY SUBPOENAED BY THE STATE ATTORNEY GENERAL’S OFFICE IN THE JERRY SANDUSKY CASE. AFTER A BOARD OF TRUSTEES MEETING LAST FRIDAY, CHAIRWOMAN KAREN PEETZ SAID THE EMPLOYEES WOULD HAVE TO GET THEIR OWN ATTORNEYS AND THAT A NEWLY FORMED BOARD COMMITTEE WOULD LOOK INTO WHETHER THE UNIVERSITY WOULD COVER THOSE COSTS. UNIVERSITY OFFICIALS HAVE SAID THEY DON’T KNOW HOW MANY PEOPLE HAVE BEEN SUBPOENAED IN THE LATEST ROUND FROM THE STATE ATTORNEY GENERAL’S OFFICE.

TRAFFIC PROBLEMS IN THE ALTOONA AREA TUESDAY AFTERNOON WHEN A LARGE TRUCK, DRIVEN BY AN OUT-OF-STATE DRIVER, KNOCKED DOWN A NUMBER OF TRAFFIC SIGNAL LIGHTS ALONG PLEASANT VALLEY BOULEVARD. POLICE ARE STILL TRYING TO FIGURE OUT WHO IS RESPONSIBLE FOR THE COST OF THE REPAIRS AND IF THE DRIVER WILL BE TICKETED FOR DRIVING THE OVERSIZED VEHICLE.
